Terms & Conditions – Saphar Travels

Thank you for choosing SAPHAR TRAVELS. We take all efforts to make sure that you have a wonderful holiday experience. To avoid any misunderstanding, we request you to read, understand, and follow the below Terms and Conditions along with our Privacy Policy before you book any tour, service, or make any transaction with SAPHAR TRAVELS at any of our offices or our authorized channel partners.

Important Note: Our Role as a Travel Agent

SAPHAR TRAVELS operates solely as a travel agent, acting as an intermediary between you (the guest) and independent service providers including airlines, hotels, transport operators, activity providers, visa agents, insurance companies, and others. We do not own, operate, or control these services directly. Our role is to facilitate bookings and provide coordination support to ensure a smooth travel experience.

All services booked through SAPHAR TRAVELS are subject to the terms and conditions of the respective third-party service providers. While we aim to offer the best arrangements, SAPHAR TRAVELS shall not be liable for any loss, damage, injury, accident, delay, additional expense, or other consequences arising from the acts, omissions, negligence, or default of external service providers.

SAPHAR TRAVELS operates strictly as a facilitator and intermediary platform. We do not directly book, issue, process, or control services such as airline tickets, visas, insurance, or other travel-related services.

All such services are: Provided directly by independent third-party service providers. Booked in the guest’s name and on their behalf. Subject to the terms, conditions, and approval of the respective providers.

Applicability
  1. These Terms & Conditions apply to all bookings and transactions with SAPHAR TRAVELS, including but not limited to:

    • Group tours

    • Customized holidays

    • Air tickets, visas, insurance, cruises, hotels, transport, or any other travel-related service booked through SAPHAR TRAVELS, whether directly, through our website, or via our authorized agents/partners.

  2. By booking with SAPHAR TRAVELS, the guest acknowledges and accepts that these Terms & Conditions are binding, irrespective of whether the booking is made online, offline, directly, or indirectly.

  3. SAPHAR TRAVELS reserves the absolute right to change, amend, or update these Terms & Conditions at any time without prior notice. Such changes will be deemed to apply retrospectively to all existing and future bookings, and continued use of our services shall be considered acceptance of the revised Terms.

  1. When a guest books a tour package or any service offered by SAPHAR TRAVELS, provides personal details, and completes payment, it shall be deemed that the guest has read, understood, and unconditionally accepted all the Terms & Conditions mentioned on our website, irrespective of whether they have reviewed them in detail or not.
  2. If the booking is made on behalf of family members, friends, or any other persons, the lead guest making the booking shall be considered as having the full authority to accept these Terms & Conditions on their behalf. It shall be the sole responsibility of the lead guest to ensure that all co-travelers are aware of and agree to the Terms & Conditions.
  3. If a booking is made for twin-sharing, and SAPHAR TRAVELS is unable to find a suitable twin-sharing partner, the booking will automatically be converted into single occupancy, and the guest will be required to pay the single-sharing rate.
  4. Guests must provide accurate, complete, and valid personal details (including passport, visa, contact, and payment details). SAPHAR TRAVELS shall not be responsible for any consequences, delays, or losses arising due to incorrect or incomplete information provided by the guest.
  5. SAPHAR TRAVELS reserves the absolute right to accept, decline, or cancel any booking at its sole discretion, without assigning any reason. In such cases, the liability of SAPHAR TRAVELS shall be limited only to refunding the amount received (after deducting applicable charges, if any).
  6. All official communication will be sent to the registered contact details (email, WhatsApp, SMS, or phone). SAPHAR TRAVELS shall not be liable for message delivery failures or delays caused by incorrect contact information provided by the guest, technical errors, or failures of third-party networks, platforms, or service providers.
  7. Only written communication issued by SAPHAR TRAVELS via email, WhatsApp, or official documentation shall be considered valid. Any verbal assurances, promises, or commitments made by staff, agents, or representatives shall not be binding unless confirmed in writing by SAPHAR TRAVELS.
  8. Any pre-booking communications, verbal agreements, or screenshots do not constitute confirmation.
  1. Guests can make payments by Cheque, Demand Draft, NEFT, RTGS, IMPS, or UPI apps (BHIM, GPay, PhonePe, PayTM, etc.). All payments must be made strictly in the name of SAPHAR TRAVELS only.
  2. SAPHAR TRAVELS will notify the guest of the amount actually received in its bank account. In case the received amount is less than the invoice amount due to transaction limits, technical deductions, or any shortfall, the balance must be borne and paid by the guest only.
  3. Any convenience charges or transaction fees levied by the bank, payment gateway, or UPI platform are the sole responsibility of the guest and are non-refundable.
  4. A booking shall be considered valid and confirmed only after the full amount is credited to SAPHAR TRAVELS’ bank account. Payment screenshots, transaction confirmations, or pending transactions will not be treated as proof of payment until the amount reflects in our account.
  5. Tour prices are dynamic and subject to change based on booking timelines, availability, and foreign exchange fluctuations. Early bookings may attract lower rates while last-minute bookings may be higher. No requests for refunds, adjustments, or discounts will be entertained on account of price differences between guests on the same or different tours.
  6. Tour package prices are exclusive of GST & TCS, unless otherwise specified in writing. Applicable taxes must be borne by the guest.
  7. The registration amount paid at the time of booking is strictly non-refundable under any circumstances and forms part of the overall tour cost.
  8. Guests are solely responsible for ensuring timely payments as per the payment schedule communicated. SAPHAR TRAVELS reserves the right to cancel bookings for non-payment or delayed payments, and in such cases, the guest shall be liable to bear applicable cancellation charges.
  9. Guests will be liable for cheque bounce charges, bank penalties, or transaction failure fees, if any. In the event of payment failure, chargeback, or reversal, the guest remains liable for the full tour amount along with any additional administrative/legal costs incurred by SAPHAR TRAVELS.
  1. At the time of booking, guests must provide valid government-issued ID proof such as Passport, PAN Card, Aadhaar, or recent photograph, as required for verification.
  2. For international tours, it is the sole responsibility of the guest to carry valid and up-to-date travel documents, including but not limited to Passport, Visa(s), Travel Insurance, vaccination/health certificates, and any other documents required by the destination country, transit countries, or airlines.
  3. SAPHAR TRAVELS may assist in guidance and coordination for visas, insurance, or related services through third-party vendors/agents. However:
  4. SAPHAR TRAVELS does not guarantee visa approval, issuance, or timely delivery.
  5. Any rejections, delays, additional costs, or cancellations arising due to incomplete, incorrect, invalid, or missing documents shall be borne solely by the guest.
  6. If a guest is denied boarding, immigration clearance, or entry by authorities for any reason (including documentation or personal background issues), the guest will be treated as having voluntarily cancelled the tour, and applicable cancellation charges will apply.
  7. Guests must also comply with any updated travel regulations, government advisories, or health protocols (including COVID-19/medical requirements) applicable at the time of travel, at their own expense.
  1. SAPHAR TRAVELS may assist guests in applying for visas through third-party agents/embassies, but the entire responsibility for obtaining a valid visa lies with the guest.
  2. Visa fees, processing charges, courier charges, and service charges are non-refundable, regardless of approval, rejection, or withdrawal of application.
  3. SAPHAR TRAVELS has no control over embassy/consulate decisions regarding visa approval, rejection, or processing time. Delays or refusals are solely at the discretion of the concerned authorities.
  4. Guests must submit complete, accurate, and truthful information and documents as required for visa processing. Any rejection, delay, or refusal due to inaccurate, false, or incomplete documents will be the sole liability of the guest.
  5. Even if a visa is granted, entry into a country is subject to the final discretion of immigration officials at the port of entry. SAPHAR TRAVELS will not be liable in case of denial of entry, deportation, or additional questioning by immigration/airport authorities.
  6. If a guest is unable to travel due to visa rejection, delayed visa issuance, or denial of boarding/entry at immigration, it will be treated as a cancellation by the guest, and applicable cancellation charges will apply as per the company’s policy.
  7. Guests are responsible for ensuring their passport validity (minimum 6 months from date of return travel), sufficient blank pages, and compliance with any special entry/exit requirements of the destination country.
  8. All costs incurred due to re-application, additional documentation, urgent processing, or alternate travel arrangements arising from visa/immigration issues shall be borne solely by the guest.
  9. SAPHAR TRAVELS does not process, approve, or issue visas.

    Important:

    • Visa applications are submitted directly by the guest or via third-party agents
    • SAPHAR TRAVELS is not involved in decision-making, processing, or approval
    • We do not guarantee visa approval, timelines, or outcomes

    SAPHAR TRAVELS shall not be liable for:

    • Visa rejection, delay, or refusal
    • Errors in application submission by third parties
    • Losses due to visa issues impacting travel

    All visa-related matters are solely between the guest and the embassy/visa agent.

  1. SAPHAR TRAVELS shall make every effort to operate tours as per the published or confirmed itinerary. However, all itineraries are indicative and subject to change based on operational feasibility, airline/transport schedules, weather conditions, traffic, political disturbances, or any other circumstances beyond our control.
  2. In case certain sightseeing, activities, or services cannot be conducted due to force majeure events (such as natural calamities, strikes, technical failures, breakdowns, or unforeseen restrictions), SAPHAR TRAVELS may attempt to arrange alternatives, subject to time and logistical feasibility. No refund, replacement, or compensation shall be provided for missed activities.
  3. Any additional expenses arising due to rerouting, rescheduling, extended stay, alternate transport, or other adjustments shall be entirely borne by the guest.
  4. SAPHAR TRAVELS reserves the absolute right to alter, swap, reroute, curtail, or reschedule any part of the itinerary to ensure the smooth operation of the tour, while making all reasonable efforts to retain the overall tour inclusions.
  1. SAPHAR TRAVELS does not directly book or issue flight tickets. Flight arrangements, if any, are facilitated through third-party travel partners, airlines, or consolidators.

    • All airline tickets are issued directly by the respective airline or authorized ticketing partner
    • SAPHAR TRAVELS has no control over ticket issuance, PNR generation, fare rules, or availability
    • The contract of carriage exists solely between the guest and the airline

    SAPHAR TRAVELS shall not be liable for:

    • Flight delays, cancellations, rescheduling, or overbooking
    • Fare changes, seat allocation, or baggage policies
    • Ticket issuance errors by third parties
    • Any loss arising from airline-related issues

    All disputes must be resolved directly with the airline or issuing agent.

  1. Hotels provided under the tour package are generally located in the outskirts of cities (approximately 18–25 km from the city center) to ensure operational feasibility and cost-effectiveness. Guests are requested to plan accordingly.
  2. Standard check-in and check-out timings of hotels apply (generally check-in after 2:00 PM and check-out before 11:00 AM). Early check-in or late check-out is subject to availability and may attract additional charges, payable directly by the guest.
  3. In case of triple sharing rooms, most hotels provide a rollaway bed, sofa-cum-bed, or extra mattress, and the room size may be the same as that of a double room. SAPHAR TRAVELS is not responsible for room size, design, or comfort in case of triple occupancy.
  4. Hotels in Europe and many other countries do not provide complimentary bottled water. Tap water is generally drinkable and guests are expected to arrange bottled water at their own expense if required.
  5. Allocation of rooms (such as twin/double/triple, adjoining rooms, floor preference, smoking/non-smoking, or specific bed types) is strictly at the discretion of the hotel and cannot be guaranteed by SAPHAR TRAVELS.
  6. Any additional expenses such as minibar usage, room service, porterage, laundry, telephone calls, or damage to hotel property shall be borne solely by the guest and must be settled directly with the hotel.
  7. In the event of overbooking or unavailability, SAPHAR TRAVELS reserves the right to provide an alternate hotel of a similar or higher category, subject to operational feasibility.
  1. Meals will be provided strictly as per the itinerary inclusions and are usually served on a fixed-menu basis (for example: Dal, Rice, Roti, 1–2 Vegetables, 1 Non-Veg dish, Salad, Dessert). Buffet or à la carte options are not guaranteed unless specifically mentioned.
  2. Special dietary requests (such as Vegetarian, Jain, or Non-Vegetarian preferences) must be informed at the time of booking. While every effort will be made to accommodate such requests, SAPHAR TRAVELS does not guarantee the availability of special meals at all destinations.
  3. Guests are advised to carry personal food items or snacks for comfort, especially in locations where meal preferences may not be available.
  4. Missed meals due to personal reasons (late reporting, illness, excursions on your own, etc.) will not be compensated, refunded, or replaced.
  5. SAPHAR TRAVELS carefully selects restaurants and food providers for tours, but since the meals are prepared and served by independent third-party restaurants/hotels, the company is not responsible for variations in taste, quality, hygiene, service standards, or any health issues arising from the consumption of food.
  6. Any additional food, beverages, or special orders outside the fixed menu shall be payable directly by the guest.

SAPHAR TRAVELS strongly advises and recommends that all guests purchase a comprehensive travel insurance policy before departure. The policy should ideally cover:

  • Medical expenses and hospitalization
  • Accidents and injuries
  • Loss or delay of baggage/personal belongings
  • Trip cancellation, curtailment, or interruption
  • Flight delays, missed connections, or rescheduling
  • Natural calamities, strikes, or force majeure events
  1. Travel insurance is the sole responsibility of the guest. SAPHAR TRAVELS may assist in connecting guests with third-party insurance providers, but the decision to purchase, claim, or utilize insurance lies solely with the guest.
  2. SAPHAR TRAVELS shall not be held liable or responsible for any medical expenses, loss of belongings, additional costs, or financial losses incurred during the trip due to the absence of valid travel insurance coverage.
  3. Any disputes, delays, or rejections related to insurance claims are to be resolved directly between the guest and the insurance provider. SAPHAR TRAVELS has no role in claim settlement.
  1. SAPHAR TRAVELS acts solely as a travel agent/intermediary and does not own, operate, or control airlines, hotels, cruises, transport companies, visa agencies, insurance providers, restaurants, or any other third-party service providers. All travel services are provided by independent contractors and are subject to their respective terms and conditions.
  2. While SAPHAR TRAVELS takes reasonable care in selecting service providers and coordinating arrangements, the company shall not be held liable or responsible for any:
  • Loss, damage, injury, illness, accident, death, delay, or inconvenience
  • Airline, hotel, transport, or supplier failure, strike, overbooking, technical issue, or staff negligence
  • Natural calamities, political disturbances, government restrictions, or force majeure events
  • Theft, loss, or damage to personal belongings or baggage
  • Any additional expenses incurred due to delays, rerouting, cancellations, missed connections, or changes in travel plans
  1. Any claims, disputes, or compensation related to such services must be taken up directly with the respective service provider. SAPHAR TRAVELS shall provide reasonable assistance but shall not be responsible for outcomes or settlements.
  2. Under no circumstances shall SAPHAR TRAVELS’ liability exceed the amount actually paid by the guest to SAPHAR TRAVELS for the specific tour/service, and even this shall apply only in cases where negligence is proven and accepted in writing by SAPHAR TRAVELS.
  3. Under no circumstances shall SAPHAR TRAVELS be held liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to:

    • Loss of money, time, opportunity, or business
    • Emotional distress or inconvenience
    • Travel disruption losses

    SAPHAR TRAVELS’ role is strictly limited to facilitation and coordination, and does not extend to execution or delivery of services.

    Maximum liability, if any, shall be strictly limited to: The service fee/commission actually earned by SAPHAR TRAVELS, and not the total booking amount.

  1. SAPHAR TRAVELS shall not be held responsible or liable for any failure, delay, disruption, or alteration in the performance of its obligations arising directly or indirectly from circumstances beyond its reasonable control, including but not limited to:

    1. War, invasion, riot, civil unrest, strike, lockout, or industrial dispute

    2. Terrorist activity, threat of terrorism, or security restrictions

    3. Epidemic, pandemic, public health emergency, or quarantine regulations

    4. Natural disasters such as earthquake, flood, cyclone, hurricane, volcanic eruption, landslide, or fire

    5. Acts of God or force of nature

    6. Government orders, travel advisories, immigration/visa restrictions, or changes in law/regulations

    7. Airline, transport, or supplier failures, technical breakdowns, or operational issues

    8. Severe weather conditions or any unforeseen circumstance beyond the reasonable control of SAPHAR TRAVELS

  2. In such cases:

    1. SAPHAR TRAVELS reserves the right to cancel, postpone, reschedule, reroute, or curtail any part of the tour for safety and operational reasons.

    2. No refund, replacement, or compensation shall be provided for unused services or missed activities.

    3. Any additional expenses arising (such as accommodation, meals, transport, medical, or rescheduling costs) shall be borne solely by the guest.

  1. It is the sole responsibility of the guest to ensure they are medically and physically fit to undertake travel, including all activities, sightseeing, and excursions included in the tour.

  2. SAPHAR TRAVELS does not provide medical advice, evaluate individual health conditions, or certify fitness to travel. Guests with pre-existing medical conditions, allergies, or mobility restrictions must consult a qualified medical practitioner before booking.

  3. Any expenses, losses, or changes in travel plans arising due to illness, injury, hospitalization, or medical emergencies during the trip shall be borne entirely by the guest. This includes, but is not limited to, additional accommodation, transport, medical treatment, or evacuation costs.

  4. SAPHAR TRAVELS shall not be held responsible for:

    • Missed flights, sightseeing, or tour services due to health issues

    • Complications arising from pre-existing conditions

    • Any health-related disputes or claims

  5. Guests are encouraged to carry personal medications, medical certificates, and sufficient insurance coverage for health-related emergencies.

  1. All guests are expected to behave responsibly and respectfully towards fellow travelers, SAPHAR TRAVELS staff, service providers, hotel/restaurant staff, and local communities.
  2. Guests must adhere to the tour itinerary, timings, and instructions provided by the tour manager or SAPHAR TRAVELS representatives. Delays caused by individual guests may result in missed activities, and SAPHAR TRAVELS will not be liable for such losses.
  3. SAPHAR TRAVELS reserves the right to remove or deny participation to any guest whose behavior is deemed disruptive, abusive, illegal, or unsafe. In such cases, no refund or compensation shall be provided, and the guest shall be responsible for any costs incurred (including additional travel, accommodation, or legal penalties).
  4. Guests must comply with all safety rules, local laws, airline regulations, hotel policies, and transportation guidelines. SAPHAR TRAVELS shall not be responsible for any fines, penalties, or legal consequences arising from violation of these rules.
  5. Alcohol, drugs, and illegal substances are strictly prohibited unless specifically allowed under local law. SAPHAR TRAVELS is not liable for incidents arising from misuse or violations by guests.
  6. Guests must take care of personal belongings and are responsible for securing passports, money, gadgets, and other valuables. SAPHAR TRAVELS is not liable for loss, theft, or damage of personal items.
  7. Any damages caused by guests to hotels, transport, or third-party property will be charged directly to the guest, and SAPHAR TRAVELS reserves the right to recover such costs from the guest.
  8. SAPHAR TRAVELS reserves the right to terminate services or tours for guests who repeatedly ignore rules, compromise group safety, or endanger themselves or others. Such termination will be at the guest’s expense, and no refund will be provided.
  1. Registration/Booking Amount: The registration amount paid at the time of booking is strictly non-refundable under any circumstances.

  2. Cancellation by Guest:

    1. Cancellation requests must be made in writing/email to SAPHAR TRAVELS.

    2. Cancellation charges are time-bound and applicable as per the date of notice, based on the policies of airlines, hotels, and tour suppliers.

    3. Any non-refundable costs incurred from airlines, hotels, transport, or other third-party providers will be borne entirely by the guest.

    4. SAPHAR TRAVELS may retain a portion or full amount of the tour cost depending on the timing of cancellation and services already booked.

  3. Partial or Missed Services:

    1. No refund, credit, or compensation will be provided for missed sightseeing, meals, activities, flights, or transport due to personal reasons, delays, or failure to adhere to the itinerary.

    2. Any additional expenses incurred due to missed services (alternate transport, accommodation, meals) will be borne solely by the guest.

  4. Force Majeure Cancellations:

    1. In the event of force majeure circumstances such as natural disasters, political unrest, epidemics/pandemics, strikes, or government restrictions, SAPHAR TRAVELS reserves the right to cancel, postpone, reschedule, or reroute the tour.

    2. Guests will not be entitled to any refund, compensation, or claim for damages arising due to such events.

    3. Any additional expenses incurred due to rescheduling or alternate arrangements shall be borne solely by the guest.

  5. Refund Process:

    1. Where applicable, refunds (after deducting non-refundable costs and cancellation charges) will be processed only after all third-party suppliers release funds.

    2. Refunds, if any, shall be made to the person whose name appears on the booking/payment receipt, and SAPHAR TRAVELS shall not be responsible for delays due to bank/transfer processes.

  6. No Waiver:

    1. SAPHAR TRAVELS reserves the right to amend or update this cancellation and refund policy at any time. Continued use of our services constitutes acceptance of the updated policy.

  1. All bookings made through SAPHAR TRAVELS are subject to the terms and conditions of the respective third-party service providers, including but not limited to airlines, cruise lines, hotels, transport vendors, activity operators, and visa/insurance agencies.

  2. SAPHAR TRAVELS acts solely as a facilitator or agent and has no control over the operations, services, policies, or decisions of third-party providers.

  3. Guests acknowledge and accept that:

    1. Any changes, cancellations, rescheduling, or service limitations imposed by third-party providers are binding.

    2. SAPHAR TRAVELS cannot guarantee or modify third-party policies, schedules, or services.

    3. Any additional charges, penalties, or fees arising from third-party actions must be borne solely by the guest.

  4. SAPHAR TRAVELS will provide reasonable assistance in coordinating with third-party providers, but shall not be liable for:

    1. Delays, service failures, or defaults by third-party providers

    2. Loss, damage, or inconvenience arising from third-party policies

    3. Any claims, disputes, or compensations related to third-party services

  1. All bookings, services, and agreements with SAPHAR TRAVELS shall be governed exclusively by the laws of India.
  2. Any and all disputes, claims, or proceedings arising out of or in connection with the services provided by SAPHAR TRAVELS shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India.
  3. Guests expressly agree that no other courts, forums, or jurisdictions outside Mumbai, India shall have authority over any claims, disputes, or proceedings relating to bookings or services provided by SAPHAR TRAVELS.
  4. By making a booking with SAPHAR TRAVELS, guests acknowledge and accept these terms as binding and enforceable.
